These terms and conditions ("Terms and Conditions") outline the rules and regulations for the use of Hu Master UK LTD's website located at: https://hukitchen.co.uk ("Website").  

Hu Master UK LTD (company number 13100545) and our registered office is located at: 5 New Street Square, London, United Kingdom, EC4A 3TW. Our VAT registration number is 13100545.

By accessing the Website you accept these Terms and Conditions in full. Any products you order through the Website are supplied subject to these Terms and Conditions. We recommend that you print a copy of these for future reference. Please do not continue to use the Website if you do not accept all of the Terms and Conditions.

We reserve the right to change these Terms and Conditions from time to time by changing them the Website. These terms and conditions were last updated on 15th September 2021.

Unless stated to the contrary, the following terminology applies to these Terms and Conditions: “you” and “your” refers to you, the person accessing this Website and accepting  the Terms and Conditions. " company", “ourselves”, “we”, “our” and "us", refers to Hu Master UK LTD. Where the context provides, “party”, “parties”, or “us”, refers to both you and ourselves, or either the you or ourselves. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.


Access to the Website 

It is your responsibility to ensure your equipment (computer, laptop, netbook, tablet or other mobile device) meets all the necessary technical specifications to enable you to access and use the Website and is compatible with the Website. 

We cannot guarantee the continuous, uninterrupted or error-free operability of the Website. There may be times when certain features, parts or content of the Website, or the entire Website, become unavailable (whether on a scheduled or unscheduled basis) or are modified, suspended or withdrawn by us, in our sole discretion, without notice to you. You agree that we will not be liable to you or to any third party for any unavailability, modification, suspension or withdrawal of the Website, or any features, parts or content of the Website.


Use of the Website 

You may only use the Website for non-commercial use and only in accordance with these terms and conditions. You may retrieve and display content from the Website on a computer screen, print and copy individual pages and, subject to the next section, store such pages in electronic form. Additional terms may also apply to certain features, parts or content of the Website and, where they apply, will be displayed on-screen or accessible via a link. 

You must only use the Website and anything available from the Website for lawful purposes (complying with all applicable laws and regulations), in a responsible manner, and not in a way that might damage our name or reputation or that of any of our affiliates.

All rights granted to you under these Terms and Conditions will terminate immediately in the event that you are in breach of any of them.

Personal Information

We collect personal information about you when you use our Website. We do so in accordance with our Privacy Policy.

Unless otherwise stated, Hu Master UK LTD and/or it’s licensors own the intellectual property rights for all material on the Website (including text, graphics, software, photographs and other images, videos, sound, trade marks and logos). All intellectual property rights are reserved. Except as expressly set out here, nothing in these terms and conditions gives you any rights in respect of any intellectual property owned by us or our licensors and you acknowledge that you do not acquire any ownership rights by downloading content from the Website. In the event you print off, copy or store pages from the Website (only as permitted by these terms and conditions), you must ensure that any copyright, trade mark or other intellectual property right notices contained in the original content are reproduced. You may view and/or print Website pages for your own personal use subject to restrictions set in these Terms and Conditions.

You must not:

  • Republish material from the Website. 
  • Sell, rent or sub-license material from the Website. 
  • Reproduce, duplicate or copy material from the Website Redistribute content from the Website (unless content is specifically made for redistribution).

Content

We may change the format and content of the Website from time to time. You agree that your use of the Website is on an 'as is' and 'as available' basis and at your sole risk. 

Whilst we try to make sure that all information contained on the Website (other than any user-generated content) is correct, it is not intended to amount to authority or advice on which reliance should be placed. You should check with us or the relevant information source before acting on any such information.

We cannot and do not guarantee that any content of the Website will be free from viruses and/or other code that may have contaminating or destructive elements. It is your responsibility to implement appropriate IT security safeguards (including anti-virus and other security checks) to satisfy your particular requirements as to the safety and reliability of content.


User Reviews

Users will be able to submit reviews of the products that they have purchased ("Reviews") by [either clicking on the "Write A Review" button located on each product page or] following the dedicated link contained in an email or SMS message that we send to you. Hu Master UK LTD does not screen, edit, publish or review Reviews prior to their appearance on the website, nor do we actively moderate Reviews after they are posted. Reviews do not reflect the views or opinions of Hu Master UK LTD, its agents or affiliates. Reviews reflect the view and opinion of their author. To the extent permitted by applicable laws Hu Master UK LTD shall not be responsible or liable for the Reviews or for any loss cost, liability, damages or expenses caused and or suffered as a result of any use of and/or posting of and/or appearance of the Reviews on this Website.

If you submit a negative Review, we may temporarily take this down and contact you to understand why you have submitted such Review and discuss if/how we may resolve your negative experience. If after having contacted you, you wish for your Review to be reinstated, we will do so. 

Reviews submitted by you must not do any of the following and where we find this is the case, we reserve the right to permanently take down your Review:

  • Contain, transmit, distribute, link to or otherwise make available, or advertise or promote any content that infringes any intellectual property rights or data protection, privacy or other rights of any other person, is defamatory or in breach of any contractual duty or any obligation of confidence, is obscene, sexually explicit, threatening, abusive, harassing, inciteful of violence or hatred, blasphemous, discriminatory (on any ground), liable to cause anxiety, alarm or embarrassment, knowingly false or misleading, or that does not comply with all applicable laws and regulations or is otherwise objectionable.
  • Impersonate any person or entity or otherwise misrepresent your relationship with any person or entity.
  • Contain, transmit or distribute any unsolicited or unauthorised advertising, marketing or promotional material or other form of solicitation (spam).
  • Transmit or distribute any virus and/or other code that has contaminating or destructive elements.

Complaints about the content of any Reviews must be sent to uksupport@hukitchen.com and must contain details of the specific Review giving rise to the complaint.


External links

The Website may, from time to time, include links to external sites, which may include links to third party offers and promotions. We include these to provide you with access to information, products or services that you may find useful or interesting. We are not responsible for the content of these sites or for anything provided by them and do not guarantee that they will be continuously available. The fact that we include links to such external sites does not imply any endorsement of, or association with their operators or promoters.


Hyperlinking to our content

You may only link to our Website with our prior written approval. We will approve link requests from these organisations if we determine that: (a) the link would not reflect unfavourably on us or our accredited businesses (for example, trade associations or other organisations representing inherently suspect types of business, such as work-at-home opportunities, shall not be allowed to link); (b) the organization does not have an unsatisfactory record with us; (c) the benefit to us from the visibility associated with the hyperlink outweighs the absence of Hu Master UK LTD; and (d) where the link is in the context of general resource information or is otherwise consistent with editorial content in a newsletter or similar product furthering the mission of the organization.

Allow 2-3 weeks for a response.

Approved organisations may hyperlink to our Website as follows:

  • By use of our corporate name; or
  • By use of the uniform resource locator (web address) being linked to; or
  • By use of any other description of our Website or material being linked to that makes sense within the context and format of content on the linking party's site.

No use of our logo or other artwork will be allowed for linking absent a trademark license agreement.

Iframes

Without prior approval and express written permission, you may not create frames around the pages on our Website or use other techniques that alter in any way the visual presentation or appearance of our Website.


Disclaimer

Nothing in this disclaimer or these Terms and Conditions will:

  1. limit or exclude our or your liability for death or personal injury resulting from negligence;
  2. limit or exclude our or your liability for fraud or fraudulent misrepresentation;
  3. for breach of any term implied by the Consumer Rights Act 2015 and which, by law, may not be limited or excluded; or
  4. limit or exclude any of our or your liabilities in any way that is not permitted under applicable law.

The limitations and exclusions of liability set out in this section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer or in relation to the subject matter of this disclaimer, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.

Subject to this, in no event shall we be liable to you for any business losses and any liability we do have for losses you suffer is strictly limited to losses that were reasonably foreseeable. 


Ordering

Products may be ordered by clicking on the item(s) you wish to purchase and adding them to the basket. Once you have finished selecting your item(s) you may proceed to the electronic order form by viewing your basket and clicking "Checkout". You may check and correct any input errors in your order up until the point at which you submit your order to us by clicking the "Pay Now". By completing and submitting an electronic order form, you are making an offer to purchase products which, if accepted by us, will result in a binding contract. 

Please note that orders will not be accepted until we have authorisation from your payment card issuer. We will not be liable if there is a delay, and we will not accept your order if payment is not authorised.

After you have placed your order:

You will receive an email to acknowledge your order. It will confirm which products you have ordered. This email is not an order acceptance from us. Where we accept your order, we will confirm such acceptance by sending you a confirmation that your order has been despatched ("Order Confirmation"). The contract between you and us in relation to the products ordered ("Contract") will only be formed when we send you the Order Confirmation. After entering into the Contract, we will be under a legal duty to supply you with the products that are in conformity with the Contract.

The Contract will relate only to the products which have been confirmed in the Order Confirmation. We will not be obliged to supply any other products which may have been part of your order until such products have been confirmed in a separate Order Confirmation. 

We do not have to accept your order, and for example, we will not accept your order if:

  • We do not have the products in stock.
  • Your payment is not authorised.
  • There is an error on our Website regarding the price or other details of the products.
  • We reserve the right to refuse any order.

In the event that an error is made by the you in ordering, we are not responsible for this error. If this is the case, please contact uksupport@hukitchen.com as soon as possible and we will do our best to resolve any issues with, but once an order is shipped we cannot make changes to the order.

Whilst we use reasonable endeavours to carry sufficient stock, if your order includes any products not available from stock or which have been discontinued, we will notify you and offer you a replacement or refund.

From time to time, certain new products may, where indicated on the relevant product page, be pre-ordered (i.e. you may place an order before the relevant product has been generally released and become available on the Website). Where this is the case, the availability date will be shown on the relevant product page. 

While we make every effort to ensure that the products shown on our website are currently available at the price shown, we cannot guarantee that this will always be the case. If products you have ordered are unavailable, you will be notified as soon as possible.

We guarantee a minimum of 30 days shelf life on products dispatched for website orders. In the case of our January 2024 Gift with Purchase campaign, we will guarantee a minimum shelf life of 7 days on receipt of delivery in order to minimise food waste. These bars currently have a best before date of 28th January 2024, please bear this in mind when placing your order.


Price and payment

The price you pay is the price of the products shown at the time you place your order, even if the price of the product has since changed. There are no retroactive discounts or price changes. Prices include VAT but exclude delivery costs, which will be automatically added once you have selected your chosen different delivery method. 

Payment for all orders must be made by credit or debit card on the payment page. We accept payment by most major credit and debit cards. You should be aware that online payment transactions are subject to validation checks by your card issuer and we are not responsible if your card issuer declines to authorise payment for any reason. Please note, it is possible that your card issuer may charge you an online handling fee or processing fee. We are not responsible for this.

Your payment card will be debited for your order at the time the order is placed. By submitting an online order with Hu Master UK LTD, through the Website, you enter into an obligation to pay for the products and you expressly agree not to request a ‘charge back’ of any fees or payments for said orders, and that no dispute with Hu Master UK LTD, will be raised with or adjudicated by the credit card company. Rather, you agree to contact Hu Master UK LTD, directly to resolve the issue or obtain a refund pursuant to the product guarantee.

Where an offer mentions that an item is reduced in price, eg: half-price, the discount will be calculated at checkout before any postage or packaging charges are applied. Only one promotion may be used at a time. You must hit the "APPLY" button when you enter a discount code for it to be activated. If a discount code is not applied, no retroactive discounts will be awarded. If you have trouble with a discount code on a mobile device, try ordering through your desktop or laptop computer. All discounts are offered at the sole discretion of Hu Master UK LTD and may be revoked at any time.


Delivery information

For orders to UK addresses, we will try to ensure that all orders placed before 11am GMT on a weekday will be received within 72 hours of Order Confirmation. Where this cannot be achieved your order will be fulfilled by the delivery date set out in the Order Confirmation or, if no delivery date is specified, then within 4 business days after the date of the Order Confirmation, unless there are exceptional circumstances.

If you place a pre-order before the availability date shown on the relevant page of our Website (and we accept it), the pre-ordered products will be despatched on the availability date and delivered by the delivery date set out in the Order Confirmation but in any case not later than 4 business days after the date of the Order Confirmation.

Your order will be delivered to the delivery address you specify when placing your order. If your delivery address is geographically remote, for example certain outlying islands or other isolated locations, it is possible that we may not be able to deliver there. If that is the case, we will notify you before we accept your order. Orders cannot be delivered to PO Box or similar addresses. 

Products comprised within the same order cannot be delivered to different addresses.

Deliveries are made by Royal Mail or DPD (UK) (within the United Kingdom) and take place on Monday to Saturday, excluding bank and public holidays, usually within the hours of 8am and 5pm. It is not possible to specify a precise time at which a delivery will take place. Please note that the courier may require deliveries to be signed for.

Deliveries will be made to your door. Our courier will not be responsible for any additional carrying, unpacking or positioning of products. 


Delivery outside the United Kingdom

If you order products for delivery outside the United Kingdom, they may be opened and inspected by customs authorities and may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

Please also note that you must comply with all applicable laws and regulations of the country for which the product(s) are destined. We will not be liable for any breach by you of any such laws.


Risk and ownership

The products ordered will be at your risk from the time of delivery or collection (as the case may be). Ownership of the products ordered will also pass to you on delivery or collection (as the case may be), provided full payment of all sums due in respect of the products, including any delivery charges, has been received.


Our subscription 

We offer subscription packages for our chocolate bars. Our subscriptions mean you get a steady stream of chocolate delivered to your door (that you can choose to have delivered every 4, 6 or 8 weeks), and are charged automatically when your new order is shipped. You can sign up for our subscription by selecting this purchase type on the main product page and clicking "ADD TO BASKET". 

You can change your shipping information and delivery frequency by logging into your ReCharge account and updating the address associated with your order. To apply to your next order, this must be done at least 48 hours before your order is set to be shipped. Or alternatively you can reach out to us at uksupport@hukitchen.com. 

Your subscription will automatically renew until cancelled. You can cancel or update your subscription order at any time (as long as it is at least 48 hours before your order is set to refill - otherwise the change will apply to the next order) to do this please reach out to us at uksupport@hukitchen.com. 


Cancellations and returns

Unfortunately because chocolate is a perishable product you will not have any right to cancel a Contract for the supply of our products unless such products were damaged or faulty when delivered to you or have been incorrectly delivered. We do not accept returns to our address and kindly ask that you do not attempt this. If you have received damaged or faulty products please reach out to uksupport@hukitchen.com as soon as possible and our team arrange for either a refund of the price of the product or a product replacement. 

Refunds are made using the same method originally used by you to pay for your purchase, unless agreed otherwise. If you received any promotional or other discount when you paid, any refund will only reflect the amount you actually paid.

Details of the consumer rights described above, and an explanation of how to exercise them, are provided in the Order Confirmation. Nothing in this section affects your legal rights.


Product information

Whilst we have taken reasonable steps to depict products as accurately as possible through the photographs and other images featured on the Website, the detailing (such as colour, pattern and texture, etc.) you see on-screen will depend on your monitor and, as such, may not exactly reflect the actual detailing of a product when you receive it.


When you purchase from us

If we fail to enforce any of our rights, that does not result in a waiver of that right. 

If any provision of these terms is found to be unenforceable, all other provisions shall remain unaffected.

These terms may not be varied except with our express written consent.

These terms and any document expressly referred to in them represent the entire agreement between you and us in relation to the subject matter of any Contract. We are required by law to advise you that Contracts may be concluded in the English language only and that no public filing requirements apply.

These terms and conditions shall be governed by English law, except that  if you live in Scotland or Northern Ireland a country of the European Union, there may be certain mandatory applicable laws of your country which apply for your benefit and protection in addition to or instead of certain provisions of English law. 

You agree that any dispute between you and us regarding these terms and conditions or the Website will only be dealt with by the English courts, except that (if you are a consumer and not a business user) and if you live in Scotland or Northern Ireland a country of the European Union, you can choose to bring legal proceedings either in your country or in England, but if we bring legal proceedings, we may only do so in your country.


Competitions

From time to time we may run competitions. Any such competitions will be subject to their own terms and conditions.
